1. Acceptance of Terms

1.1 Agreement to Terms: By accessing or using Auto Ave’s services, you agree to have read the terms and conditions set forth therein, which constitute a legally binding agreement between you and Auto Ave.

1.2 Amendments to Terms: Auto Ave reserves the right to modify these terms at any time. Changes will be effective upon posting on the website and app, otherwise, the date of effectivity is therein stated in the notice of the modification. Your continued usage of the service indicates that you have read, and therefore, accepted the changes and/or amendment and/or additions to the concurrent terms and conditions of Auto Ave.

1.3 Eligibility: You must be at least 18 years old to use Auto Ave services. Otherwise, consent must be secure prior to usage, membership, and availment of our services. This consent must be in writing and is properly signed by an eligible guardian/parent.

Validity, consistency, and genuineness of the presented (a) Identification Card/s of prospect member, including their parent/guardian; (b) ORCR of the vehicle to be registered for membership; are NOT for Auto Ave to do. In this instance, Auto Ave presumes all details disclosed by the prospect member are valid.

A person with mental disability (PWMD) is not allowed to use or have access to or be a member unless it is proven that the PWMD is able for such memberships, of which assessment shall be for the sole discretionary of Auto Ave.

1.4 Disagreement. If you do not agree to these Terms and Conditions, please immediately cease the use of any membership services.

By accessing or using any of the membership services, and by signing this agreement through manual written paper, or electronic means, you agree to be bound and abide by this agreement, and any amendments thereto. Please read this agreement carefully before using any of the membership services, especially since this agreement may affect your legal rights, such as requiring binding individual arbitration, and limiting your right to bring a lawsuit or class of action.

2. Services Provided

2.1 Service Availability: Auto Ave offers car wash, detailing, and other related automotive services using the latest technology available. Availability of specific services may vary on location and period.

2.2 Service Limitations: Auto Ave may limit the availability of certain services based on demand, location, or other factors to be determined solely by Auto Ave.

Lead time of services may change from time to time due to factors beyond the control of Auto Ave such as but not limited to vehicle long queue, machine technical issues, and force majeure, etc.

2.3 Service Modifications: Auto Ave reserves the right to modify or discontinue any service at any time, with prior notice to members. Members are bound to check from time to time their app’s notification regarding modification, changes in services, changes in price membership, and other related benefits and packages offered by Auto Ave during the membership period.

3. Membership and Subscriptions

3.1 Membership Benefits: Membership provides access to unlimited car washes, exclusive discounts, and special offers across all Auto Ave branches.

3.1 Transfer of Membership. Transfer of membership from one person to another is prohibited. Except when the transferor member’s registered car is sold or is assumed balance liability; hence, the new owner is entitled to the unexpired term of membership. And, provided that the new owner is eligible to be a member, and all related updates were made.

3.2 Subscription Fees: Membership fees are charged monthly, of which payment must be made via the methods provided in the app. Failure to pay may result in service suspension. Eventually, with proper and prior notice, eventually, Auto Ave has the right to terminate its membership.

In case of app malfunction or down period, the member is encouraged to make screenshots, and to communicate the case to any Auto Ave’s representatives.

3.3 Pre-Selling Installments: For pre-selling subscriptions, once business operations begin, installment payments must be made on or before the due date. Failure to pay on time will result in the forfeiture of the subscription without a refund.

3.4 Improper Use of Subscription: Any improper usage, such as but not limited to membership of multiple vehicles with single plate, or any fraudulent use of the subscription is subject to investigation. If proven under investigation of Auto Ave’s authorized representatives, Auto Ave reserves the right to terminate the subscription with no refund.

4. Service Quality

4.1 Standard of Service: Auto Ave aims to provide high-quality services, but does not guarantee a member’s perceived specific outcomes for each car wash.

4.2 Reporting Issues: If you are unsatisfied with a service, you must report the issue within 24 hours for review. Auto Ave is bound to acknowledge these issues and will give its feedback on the reported issue within 48 House after formally receiving the issue.

5. Vehicle Damage

5.1 Pre-Existing Conditions: Auto Ave is not responsible for damage/s that existed prior to the service or membership. If during membership, the registered member vehicle sustained damage elsewhere, the member is bound to report such to Auto Ave.

5.2 Liability for Damage: Auto Ave’s liability for any vehicle damage during service is limited to the cost of the service provided.

5.3 Inspection: Clients are encouraged to inspect their vehicle for damage before, and especially after the service. In case of suspected damage, the client is to report such within 24 hours after the service is made.

5.4. Damage to Auto Ave Property by a Member. In cases where the vehicle happened to damage any of the structures or machines by Auto Ave, at any time, prior, during, or after service, Auto Ave shall conduct due diligence and investigation. If proven, the member is liable for the current fair market value of the property damage.

5.5 Insurance. Auto Ave is a business of due diligence and is covered by insurance throughout its business operation. The availed insurance may not cover damage to the member’s vehicle.

6. Data Privacy

6.1 Data Collection: Auto Ave collects personal and vehicle-related data to provide services. By using our services, you consent to this collection of data.

6.2 Data Usage: The usage of data collected is limited to improving services, processing payments, and offering personalized experiences.

6.3 Data Protection: Auto Ave uses industry-standard security measures to protect your data. but is not liable for unauthorized access beyond our control.

6.4 CCTV Monitoring: Our facilities may be monitored by CCTV for security and service quality purposes.

6.5 Privacy Compliance: Auto Ave adheres to all applicable data privacy laws.

7. Liability Limitations

7.1 No Warranty: Auto Ave provides services "as is," without any express or implied warranties.

7.2 Limitation of Liability: Auto Ave’s liability is limited to the direct cost of services provided and does not cover incidental or consequential damages.

7.3 Indemnification: You agree to indemnify Auto Ave against any claims, damages, or losses arising from your use of our services.

8. Payment and Refund Policy

8.1 Payment Terms: Payments for services are due at the time of service, or according to the payment term agreed upon.

8.2 Refund Policy: Refunds are issued only for services not rendered, or in cases where Auto Ave is unable to fulfill the service due to its fault.

It is understood that non-usage of the car wash does not allow early termination of membership, nor does it warrant a refund of any type. Furthermore, that non-usage of the car wash does not affect any payment terms and conditions of this agreement and that Auto Ave is in no way responsible for the member’s level of usage of the car wash, and it is not the responsibility of Auto Ave to notify members of their non-usage thereof.

8.3 Disputed Charges: Disputed charges must be reported within 30 days from the transaction, for review. In return, Auto Ave is obliged to revert these disputed charges within 30 working days upon receipt of the report.

9. Dispute Resolution

9.1 Arbitration Agreement: Any disputes will be resolved first through arbitration by a competent arbitrary body, which is elected mutually by both parties.

9.2 Governing Law: These terms are governed by the laws of the Republic of the Philippines.

10. Service Interruptions

10.1 Force Majeure: Auto Ave is not liable for service interruptions caused by events beyond our control. These events are either acts of god or acts of man.

10.2 Equipment Maintenance: Regular and non-regular maintenance may result in temporary service disruptions, for which Auto Ave will properly notify the members through the app, website, social media newsfeed, electronic group chats, or any form of platform available.

10.3 Customer Notification: We will make reasonable efforts to notify customers of any planned service disruptions.

11. Environmental Impact

11.1 Eco-Friendly Practices: Auto Ave strives to minimize environmental impact by using water-efficient and biodegradable products.

11.2 Customer Responsibility: Customers are encouraged to support our environmental efforts by adhering to posted guidelines.

11.3 No Liability for Environmental Damage: Auto Ave is not liable for any environmental damage beyond our control, including local water restrictions or chemical runoff.

12. Modifications to Terms

12.1 Right to Modify: Auto Ave reserves the right to modify these terms at any time, without prior consultation with its Clients.

12.2 Notification of Changes to Terms and Conditions: Changes will be posted on our website and app. Continued use of services indicates acceptance of the new terms.

In case of disagreements, a report shall be posted by the member disagreeing the changes. This report shall be escalated directly to the management for action or dispute resolution.

12.3 Review of Terms: It is the customer’s responsibility to review the terms regularly to stay informed of any updates.

13. Termination

13.1 Termination by Auto Ave: We reserve the right to terminate your access to services for any reason, and of which reason may not be disclosed to you.

13.2 Termination by Client: You may terminate your membership at any time, with or without reason, through the app, but fees for the current billing cycle are non-refundable.

13.3 Effect of Termination: Upon termination, all rights granted to you under these terms will immediately cease.

14. Indemnity

14.1 Client Indemnity: You agree to indemnify Auto Ave and its affiliates against any losses or damages arising from your use of our services.

14.2 Legal Defense: Auto Ave reserves the right to assume the exclusive defense of any matter subject to indemnification by you.

14.3 Cooperation Required: You agree to cooperate with Auto Ave in the defense of any claims.

15. Vehicle Storage and Theft

15.1 Liability for Theft: Auto Ave adheres to the standard of safety under the existing laws and regulations.

Auto Ave is responsible for the theft of vehicles while inside our premises, except in cases wherein the robbery is concocted by an external party not related in any way to Auto Ave, and even the properties of Auto Ave are subjected to theft.

15.2 Client Responsibility: Customers are strictly advised to remove valuables from their vehicles before service.

15.3 Extended Storage: Vehicles left for extended periods may be subject to additional fees, and Auto Ave is not liable for any damage or loss.

16. Safety and Conduct

16.1 Safety Protocols: Clients must adhere to all posted safety protocols while on Auto Ave premises.

16.2 Right to Refuse Service: Auto Ave reserves the right to refuse service to clients who do not follow safety guidelines or exhibit disruptive behavior.

16.3 Client Conduct: Clients are expected to conduct themselves respectfully and responsibly while using our services.

17. No Waiver

17.1 Enforcement: Failure to enforce any particular provision of these terms and conditions by Auto Ave does not constitute a waiver of that provision.

17.2 Rights Retained: Auto Ave retains the right to enforce any term. at any time, regardless of prior inaction.

17.3 Partial Waivers: Waivers of specific provisions are valid only if in writing and signed by Auto Ave.

18. Severability

18.1 Severability Clause: If any provision of these terms is found to be invalid or unenforceable, it will be severed, and the remaining provisions will continue to be in effect.

18.2 Interpretation: The invalid or unenforceable provision will be replaced by a valid, enforceable provision that most closely matches the intent of the original.

18.3 Whole Agreement: These terms constitute the entire agreement between you and Auto Ave.
